This website and online store at 7labs.uk (the "Site") is operated by 7 Labs Ltd, a company registered in England and Wales under company number 17381307, whose registered office is at Office 402, U5, 399–405 Oxford Street, London, W1C 2BU.
In these Terms of Service, "7Labs", "we", "us" and "our" mean 7 Labs Ltd. "You" and "your" mean the person using the Site or placing an order.
These Terms of Service (the "Terms"), together with our Privacy Policy and our Returns and Refunds Policy, set out the basis on which we supply products to you and the terms on which you may use the Site and any related content, features, tools and services (together, the "Services").
Please read these Terms carefully before placing an order. They contain important information about your rights and ours, including how orders are accepted, how returns work, and the limits of our liability. By using the Services or placing an order, you agree to be bound by these Terms. If you do not agree to them, please do not use the Services.
Our Site is hosted on the Shopify platform, which provides the technology that allows us to supply the Services to you. Any contract for the sale of products is made directly between you and 7 Labs Ltd, not with Shopify.
1. Using the Site and your account
By using the Services you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
To place an order or create an account, you may need to give us information such as your name, email address, delivery address and payment details. You confirm that the information you provide is accurate, current and complete, and that you are entitled to provide it. Please keep your account details up to date so that we can process your orders and contact you when needed.
You are responsible for keeping your account credentials secure and for any activity carried out through your account. You may not transfer, sell or otherwise allow another person to use your account.
2. Our products
We take care to describe and illustrate our products accurately. However, the colours and appearance of products shown on the Site may vary depending on your device, screen settings and display configuration, and images are for illustration only.
Product descriptions, specifications and packaging may change from time to time. We may discontinue any product, and we may limit the quantity of any product supplied to any person, region or jurisdiction, at our discretion.
Nothing in this section affects your legal rights in respect of products that are not as described. See section 12 for more on your statutory rights.
3. Orders
When you place an order you are making an offer to buy the products in it. Your order is accepted, and a contract formed between us, only when we send you a confirmation that your order has been dispatched. We must receive and process your payment before an order can be accepted.
We may decline an order at our discretion, including where the product is unavailable, where we have identified an error in the price or description, where we are unable to authorise your payment, or where we suspect the order is fraudulent or is being made for resale.
Please check your order carefully before submitting it. Once an order has been accepted we may be unable to change or cancel it, although your legal right to cancel under section 4 is unaffected. If we cannot accept, need to change, or have to cancel your order, we will contact you using the email address, billing address or telephone number you provided.
You confirm that you are buying our products for your own personal or household use and not for commercial resale or export.
4. Cancellation, returns and refunds
If you are a consumer in the UK or EU, you have a legal right to cancel your order within 14 days of the day you (or someone you nominate) receive the goods, without giving a reason. You then have a further 14 days to return the goods to us, and we will refund you within 14 days of receiving them back or receiving evidence that you have sent them.
Certain products are excluded from this right, including sealed goods that are not suitable for return once opened for health protection or hygiene reasons, where the seal has been broken after delivery.
Full details of how to cancel, how to return an item, who pays return postage and how refunds are issued are set out in our Returns and Refunds Policy, which forms part of these Terms.
Your legal rights under the Consumer Rights Act 2015 in respect of faulty or misdescribed goods are in addition to, and unaffected by, this cancellation right.
5. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. The price you pay is the price displayed at the time your order is placed, as confirmed in your order confirmation email.
Unless stated otherwise, prices do not include delivery charges, which are shown separately before you complete your order, or any customs duties or import charges that may apply to deliveries outside the UK. Where such charges apply, they are your responsibility.
Prices, discounts and promotions may change at any time without notice. Prices on the Site may differ from prices offered elsewhere, including by third-party retailers. Promotions may be governed by their own terms and conditions; where those conflict with these Terms, the promotion terms apply to that promotion.
By submitting payment details you confirm that you are authorised to use the payment method, that the details are accurate, and that you will pay the amounts due, including delivery charges and any applicable taxes.
Despite our best efforts, a product on the Site may occasionally be incorrectly priced. If the correct price is higher than the price shown, we will contact you before dispatch to ask whether you wish to proceed at the correct price or cancel the order.
6. Delivery
Delivery timescales quoted on the Site are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or other events outside our reasonable control, although we will keep you informed where we can.
Risk in the products passes to you when they are delivered to the address you gave us. Ownership passes to you once we have received payment in full.
If no one is available to take delivery, the carrier will follow its usual procedure for redelivery or collection.
7. Intellectual property
All content on the Services, including trade marks, brand names, text, images, graphics, video, audio, product reviews and the design, selection and arrangement of that content, is owned by 7 Labs Ltd, its affiliates or its licensors, and is protected by UK and international intellectual property laws.
You may use the Services for your own personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any part of the Services without our prior written consent.
"7Labs" and our logos, product names, designs and slogans are trade marks of 7 Labs Ltd or its licensors and may not be used without our prior written permission. Shopify's name, logo and marks are trade marks of Shopify. All other marks appearing on the Services belong to their respective owners.
Except as expressly set out in these Terms, nothing grants you any licence or right in any intellectual property of 7 Labs Ltd, Shopify or any third party. All rights not expressly granted are reserved.
8. Third-party tools and links
The Services may give you access to tools or content provided by third parties, which we do not control or monitor. We provide access to such tools on an "as is" and "as available" basis, without warranties or endorsement of any kind, and we accept no liability arising from your use of them. Any use you make of them is at your own risk, and you should review the relevant third party's terms before using them.
The Services may also contain links to, or embedded functionality from, third-party websites. We are not responsible for the content, accuracy or practices of those websites. If you choose to visit them or buy from them, you do so at your own risk, and any questions or complaints should be directed to the third party concerned.
We may introduce new features, tools or resources to the Services in future. These will form part of the Services and will be subject to these Terms.
9. Feedback and user content
If you send us ideas, suggestions, reviews, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use, for example to operate, evaluate, improve and promote the Services.
You confirm that you own or have the rights to any Feedback you send us, that you have disclosed any payment or incentive you received in connection with it, and that it complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.
Feedback must not infringe anyone's rights, including copyright, trade mark or privacy rights, and must not be unlawful, defamatory, abusive, obscene or misleading, or contain malicious code. You must not impersonate another person or misrepresent the origin of any Feedback. You are responsible for the Feedback you submit, and we accept no liability for Feedback posted by you or any other user.
We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful or otherwise objectionable.
10. Prohibited uses
You may use the Services for lawful purposes only. You must not use the Services, directly or indirectly:
- for any unlawful, fraudulent or malicious purpose, or in breach of any applicable law or regulation;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, insult, defame, intimidate or harm our staff or any other person;
- to transmit false or misleading information, or to impersonate any person or organisation;
- to send unsolicited advertising or promotional material of any kind;
- to upload or transmit viruses or other malicious code;
- to reproduce, duplicate, copy, sell, resell or exploit any part of the Services;
- to collect or track other people's personal information, or to phish, pharm or pretext;
- to access the Services using any robot, spider, scraper, data-extraction tool, AI agent or other automated means, except as permitted under section 11;
- to interfere with, bypass or circumvent the security features of the Services, robot exclusion headers or other access restrictions; or
- to behave in any other way that restricts anyone's use of the Services, or that may harm us, Shopify or other users, or expose any of us to liability.
We may suspend or terminate your account or access to the Services if we consider that you have breached these Terms.
11. Automated agents
This section applies if you use, enable or cause the deployment of an Agent to interact with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or organisation, and that can run without direct supervision.
An Agent may interact with the Services only if it identifies itself and operates in accordance with this section at all times, and only if we have not asked it to stop. We may limit, including by technical means, whether and how any Agent accesses the Services.
Agents must:
- identify themselves as an Agent in every HTTP or HTTPS request, including the word "Agent" in the user agent string together with the Agent's name;
- not conceal or disguise the fact that the interaction comes from an Agent, whether by imitating human behaviour or by completing or circumventing CAPTCHAs or similar checks;
- answer truthfully any question or prompt intended to establish whether the interaction comes from a human or a machine; and
- not circumvent or avoid any measure intended to block, limit or control how Agents access the Services.
12. Your statutory rights
Nothing in these Terms affects your legal rights as a consumer. In particular, under the Consumer Rights Act 2015 the products we supply must be as described, fit for purpose and of satisfactory quality, and you have remedies if they are not.
Where these Terms conflict with your statutory rights, your statutory rights prevail.
13. Errors and omissions
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, transit times or availability. We may correct any such error and may change or update information, or cancel an affected order, at any time and without prior notice, including after you have submitted your order. Where we cancel an order for this reason, we will refund you in full.
14. Availability of the Services
We do not guarantee that the Services will be available uninterrupted or error-free. We may suspend, withdraw or restrict all or part of the Services for business or operational reasons, and will give you reasonable notice where we can.
The information on the Services is provided for general information only. While we take care to keep it accurate, we do not warrant that it is complete or up to date, and you should not rely on it as a substitute for professional advice.
15. Our liability to you
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to the products, or for defective products under the Consumer Protection Act 1987.
Subject to the above, and if you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any loss arising from your use of the products otherwise than in accordance with the instructions provided.
If you are a business customer, we are not liable to you for loss of profit, loss of business, business interruption, or loss of business opportunity, and our total liability to you in connection with any order is limited to the price paid for the products in that order.
16. Indemnity
If you are a business customer, you agree to indemnify us, Shopify and our respective affiliates, officers, directors, employees, agents and service providers against any losses, damages, liabilities and claims, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or third-party right, or your use of the Services.
We will notify you of any claim to which this indemnity applies. We may take control of the defence and settlement of the claim at your expense, but will not settle a claim imposing non-monetary obligations on you without your consent, which you may not unreasonably withhold. You will cooperate with us in defending any such claim.
This section does not apply to you if you are a consumer.
17. Suspension and termination
We may end your access to the Services at any time if you materially breach these Terms. Where we do so, you remain liable for all sums due up to the date of termination.
The following sections continue to apply after termination: Intellectual property; Feedback and user content; Our liability to you; Indemnity; Governing law and jurisdiction; and any other provision that by its nature is intended to survive.
18. Privacy
We process personal information in accordance with our Privacy Policy, which explains what we collect, how we use it and what rights you have under UK data protection law.
Because the Services are hosted by Shopify, Shopify also processes information about your use of the Site in order to provide and improve the platform. Information you submit may be transferred to and processed by Shopify and other service providers, which may be located outside the UK, subject to appropriate safeguards.
19. General
Severability. If any provision of these Terms is found to be unlawful or unenforceable, that provision will apply to the fullest extent permitted and the remainder of these Terms will continue in force.
Waiver. If we do not insist that you perform any obligation under these Terms, or delay in enforcing our rights, that does not mean we have waived those rights.
Entire agreement. These Terms, together with our Privacy Policy and Returns and Refunds Policy, form the entire agreement between us in relation to the Services and supersede any earlier agreements or versions of these Terms.
Transfer. You may not transfer or assign your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another organisation, and will tell you if we do so; this will not affect your rights under these Terms.
20. Changes to these Terms
You can review the current version of these Terms on this page at any time. We may update or replace any part of them by posting the revised version here, and it is your responsibility to check periodically for changes. Where a change is material, we will notify you in accordance with applicable law and the change will take effect on the date stated in that notice.
The Terms that apply to your order are those in force at the time your order is accepted.
21. Governing law and jurisdiction
These Terms and any dispute or claim arising out of them or their subject matter are governed by the law of England and Wales.
If you are a consumer, you may bring proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of the country where you live. If you are a business customer, the courts of England and Wales have exclusive jurisdiction.
22. Intended use of products
Our products are food supplements and are not medicines. They are not intended to diagnose, treat, cure or prevent any disease or medical condition, and they are not a substitute for a varied and balanced diet or a healthy lifestyle.
Do not exceed the stated recommended daily intake. Keep out of the reach of young children. If you are pregnant or breastfeeding, taking prescribed medication, or have an existing medical condition, please consult your doctor or pharmacist before use.
Any information provided on the Site or in our Lab articles is for general information only and is not medical advice. You should not rely on it in place of advice from a qualified healthcare professional.
